A Record Purge/File Destruction is the elimination or destruction of a non-conviction record, or conditional discharge records from local police and national RCMP files. These files typically result from arrests which did not result in convictions, because they were stayed or withdrawn. The file destruction typically includes destruction of any fingerprints or photographs taken at the time of arrest.

These types of records often come to light in record searches and background checks. However, these records cannot be considered for a Pardon. Fortunately, Pardon Services Canada has years of experience in dealing with these records. We petitions local level police to have the records destroyed.
The Purge/File Destruction Process
Each local police has its own procedures and retention policies that must be satisfied to have a record destroyed. Much like the pardon process, it begins by having the client sign the appropriate documents and provide a set of fingerprints. Evidence of the record(s) in question are gathered, both from the RCMP Identification Services, and from the relevant local level. Local level police policies are then researched , as necessary, and the petition is made to have records, photographs and fingerprints destroyed.
The Purge/File Destruction process may take from 6 – 12 months. Purge/File Destructions are not guaranteed. Police have the legal right to retain files when it serves the public’s interest to do so. However, Pardon Services Canada has a very high success rate with Purge/File Destruction applications.
Eligibility for a Record Purge/File Destruction
Any withdrawn charge or stay of proceedings record can be purged or destroyed. However, if there is also a full criminal conviction, a pardon will be needed, which will also have the effect of removing withdrawn/stayed charges, in addition to the conviction(s). For conditional or absolute discharges, only records created before July 1992 can be purged. Discharges that occurred after 1992 are automatically removed. (See FAQ – Pardon for more details )
