Welcome to the Internet site of Pardon Services Canada Inc. ("PARDON SERVICES CANADA"). These Terms and Conditions apply to this PARDON SERVICES CANADA Website. By using this PARDON SERVICES CANADA Site, or any of the products or services (collectively the "Services") available on this PARDON SERVICES CANADA Site, you agree, without limitation or qualification, to be bound by these terms and conditions and such other additional or alternative terms, conditions, rules and policies which are displayed or to which you may be directed in connection with any particular PARDON SERVICES CANADA Site or Service, all as may be modified by PARDON SERVICES CANADA from time to time in its sole discretion (collectively the "Terms and Conditions"). If you do not agree with these Terms and Conditions, you may not use this PARDON SERVICES CANADA Site or any of the Services on this PARDON SERVICES CANADA Site.

Please note that we reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms and Conditions at any time. Please check periodically for changes. Your continued use of this PARDON SERVICES CANADA Site following the posting of any changes to these Terms and Conditions will mean you accept those changes.

1. PARDON SERVICES CANADA helps its customers navigate the bureaucracy associated with the filing and processing of applications for pardons and U.S. entry waivers and record purges. We do not provide legal advice. Should you require legal assistance please consult a lawyer.
2. PARDON SERVICES CANADA guarantees you our best efforts in assisting you with your Pardon and US Entry Waiver applications.
3. OUR PARDON GUARANTEE: If your pardon is not granted by the National Parole Board, Pardon Services Canada Inc will fully refund your fees. The guarantee is subject to restrictions as set out in the Pardon Services Canada Guarantee.
4. Your confidentiality is guaranteed. All of your information is kept in secure files and will never be sold or rented to other interests. See Privacy Policy for more detail.
5. By completing an on-line application you authorize Pardon Services Canada to start working on your behalf. All fees for our services become due immediately unless you have made other payment arrangements with Pardon Services Canada.  All Payment Plan options carry an interest charge of 16% per annum on the outstanding balance and is charged at 1.33% per month.
6. Pardon Services Canada will work diligently but cannot guarantee a time frame when you will receive your results as these are based on the response times of the involved government agencies.
7. All fees are subject to change without notice.
8. Non-payment of fees in a timely manner may result in your file being placed on hold unless you have made other payment arrangements with Pardon Services Canada.
9. Pardon Services Canada cannot give guarantees of any sort for the following service packages; Basic US Entry Waiver Application Package, Premium US Entry Waiver Application Package, Record Purge Application Package or the Basic Pardon Application Package.  The above mentioned packages as identified on the Pardon Services Canada website are prepared on a “Best Efforts Bases” and carry no guarantee whatsoever.
10. Once Pardon Services Canada has received any form of Payment; all fees, disbursement costs and charges paid to Pardon Services Canada are considered non-refundable.
11. Pardon Services Canada reserves the right to reject any application.

The Pardon Services Canada Guarantee
Pardon Services Canada guarantees to obtain a pardon on your behalf or the service fee will be refunded in full.  The guarantee does not apply if you are found to be involved in criminal activity; or, as a result of our inquiries the RCMP certifies that no criminal record exists.

If you choose to terminate your pardon application for any reason the guarantee does not apply; if it is determined you are not yet eligible for a pardon, we will maintain your file and resume your application when you are eligible.  The guarantee will still apply.

Disclaimer

Except as otherwise expressly contemplated herein, changes will be effective when notice of such change is posted on this Pardon Services Canada Site. If any change is not acceptable to you, you must discontinue your use of this Pardon Services Canada Site and any of the Services immediately. Your continued use of this Pardon Services Canada Site or any of the Services after any such changes are posted will constitute acceptance of those changes. YOU EXPRESSLY UNDERSTAND AND AGREE THAT IN NO EVENT SHALL Pardon Services Canada, INCLUDING ITS AFFILIATES AND LICENSORS, BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, AND ANY DAMAGES FOR LOSS OF PROFITS, SAVINGS, GOODWILL OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER Pardon Services Canada HAD BEEN ADVISED OF OR COULD HAVE FORESEEN THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR IN CONNECTION WITH: (A) THE USE, INABILITY TO USE OR PERFORMANCE OF ANY OF THE SERVICES OF THIS Pardon Services Canada SITE, OR (B) ANY UNAUTHORIZED ACCESS TO OR MODIFICATION TO ANY OF YOUR CONTENT OR TRANSMISSIONS, OR (C) ANY OTHER MATTER RELATING TO THIS Pardon Services Canada SITE OR ANY OF THE SERVICES.

You expressly acknowledge that Pardon Services Canada has entered into this agreement, and has and will make this Pardon Services Canada Site, Content and Services available to you in reliance upon the limitations and exclusions of liability and the disclaimers set forth herein, and that the same form an essential basis of the agreememt between you and Pardon Services Canada. Termination
You acknowledge and agree that Pardon Services Canada, in its sole and absolute discretion, may, without notice to you, suspend or terminate your account or your use of, or access to, this Pardon Services Canada Site or any of the Services, and remove and discard any information or content related to this Pardon Services Canada Site or any of the Services (and your use thereof), for any reason, including where Pardon Services Canada believes that you have violated any of these Terms and Conditions. You further agree that Pardon Services Canada shall not be liable to you or to any other person as a result of any such suspension or termination. If you are dissatisfied with this Pardon Services Canada Site or any of the Services or with any terms, conditions, rules, policies, guidelines, or practices of Pardon Services Canada in operating this Pardon Services Canada Site or any of the Services, your sole and exclusive remedy is to discontinue using this Pardon Services Canada Site or any of the Services.

General Provisions
This agreement is personal to you, and you may not assign your rights or obligations to anyone. These Terms and Conditions constitute the entire agreement between Pardon Services Canada and you pertaining to your use of this Pardon Services Canada Site, Services and Content and supercede any prior agreements between you and Pardon Services Canada with respect to the subject matter hereof. Pardon Services Canada's failure to insist upon or enforce strict performance of any right or provision of these Terms and Conditions shall not constitute or be construed as a waiver of any right or provision. If any of the provisions (or parts thereof) contained in these Terms and Conditions are determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions (or parts thereof) contained herein. No changes to these Terms and Conditions shall be made except by a revised posting on this page or except as otherwise expressly contemplated herein. The parties have required that these Terms and Conditions and all documents relating thereto be drawn up in English.
